Pierre Fabre to appeal court’s decision over Argane trademark
France-headquartered cosmetics group Pierre Fabre will be appealing a decision from a Paris court that its trademark Argane no longer stands, according to press reports.
In December the Tribunal de Grand Instance in Paris concluded that the word ‘argane’ was, like ‘argan’, an Arabic word well known in French territory since the 19th century to denote a tree and its fruit often found in Morocco. For this reason the court said Pierre Fabre’s trademark on the word did not stand.
The cosmetics company has argued that it played a central role in developing the use of argan oil in cosmetics, has 4 patents related to the ingredient, and has accused natural cosmetics company Clairjoie from infringing its trademark with its product ‘karité-argane’.
It plans to appeal the decision, according to news organisation AFP.
